TVA on bathroom works

We have had a quote from a tradesman to renovate our bathroom. We're in early stages with him, still finalising queries and deciding exactly what we want to do. We haven't as yet got to the devis stage. He has great references, and we would really like him to do the work for us.

One of the questions that we posed was "was TVA included in the estimate, and if so at what rate?" His answer by email is "There's no TVA, as my turnover is too small to make it worth all the extra paperwork".

I have no idea what the trading thresholds are, but this non-registration surprises me. Is there anywhere that I can check whether he is legit from this point of view? If he is not complying, and gets caught, could we potentially be found liable for paying over un-invoiced TVA?

A auto-entrepreneur or micro-entreprise is exempt from TVA, and is legally obliged to make that declaration on all invoices, with the statement TVA non applicable, art. 293 B du CGI. He can be legit but must earn less than about €33,000 a year. He'll still need to be registered and have insurance and you should make sure that you see those documents before he starts the work.

You say he has 'great references' and would like to use him ?? did these 'great references' not supply any further details such as the question you ask ?? If you are unsure as to whether he is a genuine trader in terms of Tax affairs, then just get a quote from a larger firm/company, and rest assured you will pay all the taxes you need to, and will not be liable for any comeback in the future........simples

As Dave rightly says, if he is registered as an AE or Micro & earns below the threshold for these regimes he will not be liable to charge TVA, so maybe no worries there. Just check his Siret number to make sure he is registered for the work you want done & has insurance.
